     The court of civil appeals for this supreme judicial district has reversed and remanded the case of Charles D. Newbold vs I & G N RY Co, appealed from Falls county.  The action was brought by the plaintiff to recover of defendant damages alleged to have been done certain lots by reason of the construction of the railway on Falls street, along side of plaintiff's property.  The lower court awarded plaintiff damages and from this verdict defendant appealed, with the result as stated.
