NEW TRIAL MOTION FILED
IN MURDER CONVICTION

Action Based on Allegations of Errors
and Insufficient Testimony

       Motion for new trial was filed in Falls county district court today in the case of F. W. Grochoske, constable of justice No. 6, convicted Saturday and given a term of two years by a jury on a charge of murder in connection with fatal shooting of W. A. Rowe at a dance hall near Otto last spring.
       The action was based on allegations that the court erred in overruling defendant's motion for continuance and exceptions to the charge and further that the testimony was insufficient to sustain the verdict.
       The defendant is required to remain in custody pending action on the motion.
