The Marlin Democrat, Feb. 8, 1916
The last will and testament of the late B. C. Clark was filed with the county
clerk Monday afternoon at about 4 o’clock, and was accompanied by the usual
application that the will be probated. The application and will were filed by
E. M. Eddins, attorney for B. J. Linthicum, named in the instrument as
independent executor without bond.
The value of the estate is estimated in the application at $1,000,000.and
consist of entirely of money, bank stock, securities, etc.
The following legacies are made, all honest debt to be paid first:
The First Presbyterian Church, The Episcopal church, the Christian Church and
the Catholic Church, all of Marlin, given $1,000.00 each; The First Methodist
Church and the First Baptist Church are each given $2000. It is the request of
the testator that these amounts be used by the respective churches in the
betterment of their buildings.
The white public schools of Marlin are bequeathed the sum of $10,000.to be used
in erection of a building for industrial training. The sum of $1,000. is given
to the Negro public school of Marlin. This amount to be expended by the board
of trustees as they think best.
The Elk Lodge of Marlin, of which deceased was a member, is bequeathed the sum
of $1,000 to be expended for fixtures and furniture.
Other bequest are as follow:
For improving Robinson-Clark burial plot in city cemetery, $1,000
To Sallie Clark, wife of testator, the home place, “Highlands”, comprising 100
acres of land, residence, live stock, vehicles, etc, appertaining thereto. Also
$65,000. In money. Also $5,000 cash for each year, or fraction thereof, he
might live after the will was made.
To Mrs. Mary Crosby, D. T. Iglehart, Frank Iglehart, Mrs. F. C. Igehart, H. C.
Crawford, W. B. Crawford, W. H. W. Jones, J. C. Fountain, John Bellinger,
Rachel C. Cook(Maryland), Mrs. Mary Clarkson Carter, Mrs. Annie Burkhead, Mrs.
Louise Connally, Mrs. Marian Clarkson Buie, $1,000.
To J. W. Powers and Horace Chilton, Dove Davis, and Willie Davis, $500. Each.
To John A. Robertson , $500. Voided by death of devisee under terms of the
will.
To his brother, T. S. Clark, $5000. In money and release of all debts that may
be due to testator by T. S. Clark, and in addition thereto the store house and
lot occupied by the latter on the west side of Commerce street in Marlin.
The residue of said estate to be divided into 22 1-3 equal parts and these
parts to be given as follows:
Amanda C. Banks, Bessie Dorsey, Rose E. Linthicum, Fannie Allen, Maggie L.
Tyler, T. Clark Linthicum, one part each.
To Berdie, Laura, Lizzie and Mary, children of Wm. T. Clark, deceased, James T.
Clark, and Lewis T. Clark one part each.
To children of Upton D. Clark, by his marriage to his wife, Sue, two parts each
to be divided equally among them.
To Edwin, Rosa and Lillian Clark, two-thirds of one part each.
To Thomas and Basil, children of his sister, Maggie Linthicum, deceased, 1 1-3
parts each.
To his brother, Webster Clark, one part, and two Ernest and Ruth, children of
Webster Clark, two-thirds of one part each.
To Basil C. Clerk of Texas, two-thirds of one part.
To Bradley J. Linthicum, two parts.
All special legacies and bequests shall be paid within twelve months after
probation of will, or sooner if same can be done without detriment to the
estate be partitioned and distributed as soon as possible without detriment to
the estate.
B. J. Linthicum is allowed by the will the sum of $5,000. Compensation for his
services as executor.
The will was made on April 19, 1912, and witnessed by T. A. Cheeves and W. M.
Gunnell.
